I Used My Advance Parole After the August 13 BIA Ruling — My Experience

My AP was approved on August 13, 2026 , and I received the notification only a few hours before the major AP development that same day — the BIA’s decision in Matter of Delcarmen-Lara , which changed how departure on AP could affect the 3-year and 10-year unlawful-presence bars. As you can imagine, Reddit and immigration forums exploded with “DO NOT TRAVEL” and “DON’T USE YOUR AP.” I understood the concern, but I genuinely needed to travel. Before deciding, I went through my immigration timeline carefully — my previous I-94, when my authorized stay ended, and when USCIS received my adjustment application. Based on my dates and my understanding of my case, the period I was concerned about was only around 10 days, nowhere near 180 days . I also spoke with my attorney. Understandably, given how new the ruling was, the advice was cautious.
