Spouse's H-4 COS still pending and my H-1B extension is coming up, what to do?
My spouse had to leave their job earlier this year and filed an H-1B to H-4 change of status. It's still pending with no movement and the posted processing time is over 10 months. Based on that timeline, we don't think it will even be decided before my current H-1B petition expires. So by the time they get to it, the petition it was filed against may already be expired. My own H-1B extension is now coming due. For anyone who has been in this spot: Should we file a second I-539 bundled with my extension, or wait for the first one to approve and then file a plain extension after? If you filed a second one, how did it go? What happens if they adjudicate the original one after the underlying petition has already expired?
