K1 visa or spousal?
Hello, Im a US citizen (34m) and met my fiance (28) in the US around august 2024. She's on a b1/b2 visa and taking care her employer as a live in caregiver. They stay 4-6months in the US and back to the PH. We started as friends for more than a year and became in a relationship in feb 2026 and became engaged this month. She is set to go back to the philippines in october because her allowed stay is only until november and her visa will expire. Im thinking of starting the application process while she's here to make it easier but we are debating if we should A) apply for k1 now and she goes back to PH and wait till she gets approved B) get married here and she goes back to PH and then apply for spousal visa Also, her employer wants to renew her b1/b2 visa so she could still work for her. It would be good since we would have more time together while we wait for the approval but will it complicate the process and bring red flag? She doesnt intend to overstay or AOS.
