Can H-1B COS be approved as Consular?

I'm currently on STEM OPT and recently received an RFE related to my STEM OPT. I'm also planning to do premium processing for my H-1B, but I'm really worried that USCIS might approve my H-1B as consular processing instead of Change of Status. I spoke with a couple of attorneys, and they mentioned that if USCIS has concerns about the employer or my immigration status, they could potentially approve the H-1B but make it consular processing. Has anyone experienced this before? If you were on STEM OPT, received an RFE, and then had your H-1B approved, was it still approved as COS? Also, does receiving an RFE for STEM OPT increase the chances of USCIS approving the H-1B as consular instead of COS?
